Another fine day although a brisk wind caused a few problems but kept the rain away so not all bad.

British Consulate Meeting
Amovate would like to thank the Aljezur Câmara, especially Antonio Carvalho for arranging with the British Consulate to visit Aljezur, and talk to British Citizens and interested parties about Brexit. He welcomed the attendees and apologised for the lack of translation during the meeting last week. He also stressed how important the UK and other Nationals were to the local community, and how important is is that we are able to stay living where we are. He also thanked AEZA and Amovate for their important contributions to the local community.
The presentation covered several topics and it was excellent to get a first-hand appraisal of the current Brexit situation, and not someone’s version in the press or on Social Media.
Two important points were stressed by British Consul Simona Demuro:
- The need to be a Resident, or apply to become one before 29th March to protect your rights to stay here.
- The need to exchange your UK Driving Licence (or at least start the process) for a Portuguese one before 29th March.
She urges everyone to visit the websites below (Gov.UK) and go through the pages of information which are being updated regularly. The main topics covered were Residency, Health, and Driving Licences.
Residency: As mentioned, to protect your rights to stay in Portugal, you must be a Resident, or at least have started the process (whether it is the 5 Year Residency at the Câmara, or the 10 year Permanent Residency at SEF) before 29th March.
Health: Portuguese Health System is Residency based, so as a resident (prior to 29th March), you are entitled to Healthcare in the Portuguese system. This is the case whether there is a Withdrawal Agreement passed, or whether there is a No Deal.
In the event of a No Deal, UK issued EHIC cards will no longer be valid after 29th March. After this date, Portuguese EHIC cards may be applied for. Similarly, in the event of a withdrawal agreement, the S1 will still be valid. It is unknown what will happen if there is a No Deal scenario, but the British Consulate indicated that the two countries would work towards a bilateral agreement to cover this situation.
Driving Licence: The British Consulate stressed the importance of exchanging your UK Licence at the IMT before 29th March (or at least start the process). There was a discussion about the validity of the “White Piece of Paper” issued by IMT in the interim period before receiving your Portuguese Licence. It was stressed that this piece of paper is only valid in Portugal. There were also discussions about obtaining an International Driving Permit to cover this period, and it can be obtained with this “White Piece of Paper”. However, it is not clear, and the British Consulate did not know, whether these two documents are valid to drive / hire a car in the UK. The British Consulate advised that they would try and find out what the situation is or will be after Brexit.
They also stated that they are well aware of the chaotic situation at IMT in Faro, and the delays in obtaining Portuguese Licences, and are having discussions with IMT in the next few days.

UK Nationals Keep their Right of Residence 1
Câmara Meeting – 12 Feb
As promised, here are the bullet points of the Mayor´s speech in the Feb 12th meeting. This not the technical part of the plan given by the Architect-Engineer which in part was simultaneously translated to EN. (English) Hopefully when we have been afforded the copy of the presentation as promised, it will be translated into English and posted here.
- There were always 3 premises defined by the Câmara Municipal de Aljezur (CMA) in the elaboration of the “Plano de Pormenor do Vale da Telha” (PP Vale da Telha) : 1. No loss of rights by owners of either property or land; 2. No demolitions; 3 Environmental sustainability
- The Plan is being made in coordination with the Secretariat of State of Territory Planning and Nature Conservation, and CCDR- Algarve;
- The financial component of the plan is a complex one and involves the investment of around 35 million euros over a period of 10 years (the CMA itself functions on a 11,5 million eur annual budget). So, it is vital yet to understand which part can come from the CMA, which part can come from the Central Administration and which part can come from private sector. That will determine the execution of the PP Vale da Telha.
- In parallel, to the PP Vale da Telha, there is and Environmental Impact Assessment Evaluation process yet to be approved;
- CCDR- Algarve will coordinate the conciliation phase between all entities and institutions that will have to issue a formal opinion on the Plan. Only after that, a proposal will be put forward to a public consultation stage, in which all citizens will be asked to provide inputs and opinions;
- As it is known all building and housing permits in Vale da Telha are suspended since March 2012. Since that period lots of property and land owners have filed legal action in court against the CMA, and the courts always ruled in favor of maintaining the suspensions in place.
- But in Sep 2018, the Loulé Court determined the annulment of these suspensions, forcing the CMA to evaluate each suspended licensing process one by one;
- There is also one case where the Public Ministry asked the court to determine the demolition of one allotment in Vale da Telha, which is causing extreme concern to the CMA for they believe this is a violation of their initial premise;
- The CMA will ask for a meeting with the Portuguese attorney general, in order to ask to be given room to elaborate the PP Vale da Telha, due to constant legal actions being filed by the Public Ministry and the courts.
- It took 7 years for the Plan to get to this stage of an initial proposal. This initial proposal involves more building in the already existing plots, respecting the existing indexes, and furthermore the possibility or some more building, in order to finance the execution of the PP Vale da Telha.
- This initial proposal has yet to undergo several stages before it reaches a final proposal, and it is not expected to last less then two year (in normal circumstances), for it to be concluded. When this happens there will be a public presentation, and all questions and comments should be made in the public consultation stage of the process;
- In the future there will be a clarification session in EN considering the amount of foreign residents, for the language can not that be yet another issue to divide the Aljezur community;
